Terms of Service
Effective date:
These Terms of Service (“Terms”) are a legal agreement between you and CJCC Investment Pty Ltd (ABN 21 657 810 181), trading as TradieTally (“TradieTally,” “we,” “us,” or “our”).
By creating an account, accessing, or using the TradieTally platform at tradietally.com.au, you agree to be bound by these Terms. If you do not agree, do not use the service.
These Terms should be read alongside our Privacy Policy, which explains how we handle your personal information.
1. Definitions
- “Service” means the TradieTally web application at tradietally.com.au and the TradieTally mobile apps for iOS and Android, including all features, integrations, and associated services.
- “User” or “you” means any individual who uses the Service on behalf of a Business Customer.
- “Organisation” means the business entity associated with your TradieTally account.
- “Content” means any data, text, files, images, documents, or other materials you upload, create, or store through the Service.
- “Subscription” means a paid plan that grants access to the Service beyond the free trial period.
2. Eligibility
To use TradieTally, you must:
- Be at least 18 years of age
- Be a business, or be acting for a business, and use the Service for commercial purposes
- Have the legal authority to enter into these Terms
- Provide accurate and complete registration information
TradieTally is supplied to trade businesses for use in running those businesses. It is not offered to consumers for personal, domestic or household use. An account belongs to the business, which sets up and controls the accounts of its owner and staff.
TradieTally is sold to registered trade businesses in Australia and New Zealand. Opening an account requires a valid Australian Business Number (ABN) or New Zealand Business Number (NZBN) — an ABN or NZBN is issued only to an entity carrying on an enterprise. Features, currency, tax calculations and compliance are built for the Australian market.
3. Account registration and security
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Keep your password secure and confidential
- Not share your account credentials with others
- Notify us immediately if you suspect unauthorised access to your account
You are responsible for all activity that occurs under your account. TradieTally offers optional two-step verification via email for additional account security.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Subscription and billing
4.1 Free trial
New users receive a 21-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
4.2 Paid plans
TradieTally offers the following subscription tiers:
- Solo — $79 AUD per month ($806 AUD per year on annual billing), 1 user
- Team — $99 AUD per month ($1,010 AUD per year), which includes the account owner and 1 additional user, plus $20 AUD per month ($204 AUD per year) for each further user
Both tiers include all features. Annual billing is available at a 15% discount. Prices are in Australian Dollars and include GST where applicable. Customers on earlier or founding-customer plans (Foundation, Business) and existing subscribers keep the price and seat allowance they signed up on.
4.3 Payment processing
All payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis. We do not store your credit card details.
Subscriptions are purchased and managed through your TradieTally account. The mobile apps do not sell subscriptions or process subscription payments; your subscription applies to your account across all platforms.
4.4 Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation:
- You retain access to the Service until the end of your current billing period
- No further charges will be made after the billing period ends
- Your data is retained for 30 days after your subscription expires to allow for reactivation
4.5 Refunds
Subscription fees are non-refundable for partial billing periods. If you believe you have been charged in error, contact us at info@tradietally.com.au and we will review your case.
5. Your content and data
You retain full ownership of all Content you create, upload, or store in TradieTally. We do not claim any intellectual property rights over your business data.
By using the Service, you grant TradieTally a limited, non-exclusive licence to host, store, process, and display your Content solely for the purpose of providing the Service to you. This licence terminates when you delete your Content or your account.
You are solely responsible for the accuracy, legality, and appropriateness of all Content you enter into the platform. TradieTally does not verify, audit, or endorse any business data, quotes, invoices, or other documents you create.
6. Acceptable use
You agree not to use TradieTally to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property or privacy rights of others
- Upload malicious software, viruses, or harmful code
- Attempt to gain unauthorised access to the Service, other accounts, or our systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape, crawl, or extract data from the Service
- Impersonate another person or entity
- Send unsolicited commercial communications (spam) through connected email accounts
- Use the Service for any fraudulent, deceptive, or illegal purpose
We reserve the right to suspend or terminate access for any user who violates these terms, with or without notice depending on the severity of the violation.
7. Email integration
TradieTally allows you to connect your own email account (Gmail or SMTP) to send business documents to your customers. When using this feature:
- Emails are sent from your connected email address, not from TradieTally
- You are responsible for the content of all emails sent through the platform
- You must comply with applicable spam and electronic communications laws, including the Spam Act 2003 (Cth)
- TradieTally does not guarantee email delivery — delivery depends on your email provider and the recipient’s mail server
You can disconnect your email account at any time. See our Privacy Policy for details on how email integration data is handled.
8. Accounting integration
TradieTally supports integration with third-party accounting software (currently Xero). When using accounting integrations:
- Data syncing is user-initiated — we do not automatically push or pull data without your action
- You are responsible for verifying the accuracy of synced data in your accounting system
- TradieTally is not liable for discrepancies, errors, or data loss in your accounting software resulting from the sync
- You can disconnect the integration at any time from your account settings
9. Intellectual property
The TradieTally platform — including its design, code, branding, logos, documentation, and all associated materials — is the intellectual property of CJCC Investment Pty Ltd and is protected by Australian and international copyright, trademark, and intellectual property laws.
You may not:
- Copy, modify, or distribute any part of the Service without written permission
- Use the TradieTally name, logo, or branding for your own purposes
- Create derivative works based on the Service
As stated in Section 5, you retain full ownership of your business data and Content.
10. Service availability
We make reasonable efforts to keep TradieTally available and operational. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide reasonable advance notice where possible)
- Unscheduled outages caused by infrastructure providers, network issues, or other factors beyond our control
- Emergency maintenance to address security vulnerabilities
TradieTally does not offer a formal Service Level Agreement (SLA). We are committed to resolving any outages as quickly as possible.
11. Limitation of liability
To the maximum extent permitted by law, TradieTally and its directors, employees, and contractors shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from reliance on information generated by the Service (including quotes, invoices, or financial calculations)
- Damages arising from third-party services (Stripe, email providers, accounting integrations)
Our total aggregate liability for any claims arising from your use of the Service is limited to the total fees you have paid to TradieTally in the 12 months preceding the claim.
TradieTally is a business management tool — not a substitute for professional accounting, legal, or financial advice. You are responsible for verifying the accuracy of all documents, calculations, and data produced by the platform.
12. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees or rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). To the extent that any provision of these Terms conflicts with the Australian Consumer Law, the Australian Consumer Law prevails.
13. Indemnification
You agree to indemnify and hold harmless TradieTally, its directors, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, your Content, or your violation of any applicable law or third-party rights.
14. Termination
Either party may terminate this agreement at any time:
- You can cancel your subscription and stop using the Service at any time
- We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if required by law
Upon termination:
- Your right to access the Service ends immediately (or at the end of your billing period if you cancel a subscription)
- Your data is retained for 30 days to allow for account reactivation or data export
- After 30 days, your data will be permanently deleted unless retention is required by law
Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
15. Dispute resolution
If a dispute arises in connection with these Terms or the Service, we agree to follow this process:
- Negotiation — the parties will first attempt to resolve the dispute through good faith negotiation within 30 days of written notice
- Mediation — if negotiation fails, the parties will attempt mediation administered by an agreed mediator in Queensland, Australia
- Litigation — if mediation fails, either party may bring proceedings in the courts of Queensland, Australia
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.
16. Privacy
Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal information.
17. Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice via email before the changes take effect.
The updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service before they take effect.
18. General provisions
18.1 Governing law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
18.4 Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TradieTally regarding your use of the Service, superseding any prior agreements.
18.5 Assignment
You may not assign or transfer your rights under these Terms without our written consent. TradieTally may assign its rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
